How would allowing Capital Punishment cut down on crime in America - Research Paper Example It is argued that children, however, should not be subject to the death penalty—the only exception. â€Å"‘From a moral standpoint, it would be misguided to equate the failings of a minor with those of an adult, for a greater possibility exists that a minor's character deficiencies will be reformed,’ Justice Anthony M. Kennedy wrote in the opinion for the court.†2 In that sense, juveniles should be spared, but adults should not be. â€Å"As a child psychologist, [California State Senator Leland Yee, Ph.D., has] firsthand experience with troubled children and understands that they have an extraordinary capacity for rehabilitation. The neuroscience is clear — brain maturation continues well through adolescence and thus impulse control, planning and critical thinking skills are not yet fully developed until adulthood.†3 Thus, a juvenile stands a greater chance of being offered parole or some other opportunity that is an alternative to the standar d in a corrections facility. Perhaps the juvenile might be able to enter a program with job training and a sentence reduction in return for good behavior. The main point here is that the juvenile’s actions can show growth and change if allowed time and space to flourish—while an adult has lived much of his or her life already, having made various life choices along the way, many not so wonderful. Further, the death penalty is fitting punishment for an adult, but not for a child. As Mr. Yee pointed out, the youth’s brain is still in a developing stage at age 18 and below. â€Å"Without positive interventions to redirect the youth's development, an absence common to so many of the youth who subsequently become involved in serious delinquent or criminal activity, these youth are inappropriately subjected to the ultimate sanction without adequate regard for these mitigating circumstances.†4 Not given the appropriate chance to demonstrate his or her capability to rise above and beyond the limitations placed upon him or her due to the circumstances of a bad upbringing or abuse, a youth is faced with the serious task of having to change behavior or be disciplined for it. The death penalty, therefore, seems like a good answer to deter crime in America. â€Å"In Gregg v. Georgia (1976), the U.S. Supreme Court mandated that courts must examine mitigating circumstances when issuing the death penalty. However, most juvenile capital offenders are represented by appointed counsel without the time or resources to sufficiently investigate such mitigating factors as psychiatric history, abuse, or mental capacity.†5 With so many youth having mitigating circumstances, the death penalty is not a viable option. Now, by law, it is definitely not an option to hand down a sentence of capital punishment to juvenile offenders. However, for mentally capable adults, the death penalty is simply a permanent solution that yields results: lower crime rates. Now, while the death penalty for youth would definitely not solve underlying issues that youth may have, this neglects the fact that youth deserve a second chance to prove their worth. This is in opposition to the American culture with is founded on liberty and freedom. In addition to this, the American culture does not incorporate polygamy unlike what we see in Genesis. Also, the idea of Judah’s transferring Er’s wife to the younger brothers when he died is not applicable to the American culture. The culture of sacrificing might be found in the American culture but not to the extent of sacrificing a human being. Furthermore, another thing that caught my fancy in the book of Genesis that is alien to the American culture is the birth of Isaac even when both Abraham and Sarah have passed their reproductive age. Apart from this, the American society is not a patriarchal society where the man rules and women are seen as the â€Å"weaker vessels†. Also, the manner in which marriage is recorded in the book of Genesis is quite different from what applies to the American culture. The practice of parents looking for a wife for the son or vise versa is strange to the American culture. As the book of Genesis records it, marriage is preferred between relatives, even as close as cousins. As society becomes more informed on the issue of the environment, they too become more impatient, and feel that in the snap of fingers, the damage can be reversed and future damage can be stopped instantaneously. Because of this the government has been put into a major predicament. They have, and must continue to create laws, to protect the environment. However they cannot simply place unrealistic restrictions and limitations onto the major polluters; that are the manufacturing companies. The Happy Girl Jackie's small features curled up in horror as I unceremoniously plopped down on the hotel room floor. "Ew! That's so disgusting, Sarah!" she exclaimed, stomping her slipper-clad foot soundly on the floor. "I can't believe that you're sitting on the carpet! You know how germ-a-phobic I am!" Rolling around some more, I laughed as her hands clasped around a jumbo-sized container of Lysol. Even on the band trip to Colorado, she was still as cautious of "infection" as ever. Shaking her head at me, she smiled somberly as she shook the can, preparing to thoroughly disinfect our room. Based on this alone, most people would classify Jackie as, well, a freak. Most likely, they'd be right. But she's "freaky" in an amazingly wonderful sort of way. I've known Jackie since sixth grade. When I first went to West Hempfield Middle School, I didn't know many people. Most of my friends were sent to Harrold, while others became "popular" seemingly overnight, leaving their slightly geeky bookworm of a best friend behind as they went on to become cheerleaders, athletes, or student government representatives. One of the girls from my homeroom that I quickly befriended introduced me to Jackie at the beginning of the school year during sixth-grade lunch. From the moment we met, I knew that we'd make great friends. We had a lot in common, including interests in music (we both play clarinet), television (we're both huge X-Files fans), and art. Even when we'd disagree about something, she was still fun to be around. Jackie is the kind of girl that is always perky, helping anyone out of a bad mood, even when she's in one herself. I can't help but smile when I talk to her; her happiness is seemingly infectious. On any given day, Jackie's outward appearance is bound to be something unique and creative. With her traditional Italian looks - thick black hair, dark brown eyes, and lightly tanned skin - she can easily dress in many different styles and still look adorable. Nichols managed to escape the facility and carjacked a vehicle at gunpoint, after assaulting the cars owner. though he never actually took the car. He allegedly stole another car, this time taking owner with him. William allegedly killed a US Customs Agent the following day and then approached women at an apartment complex and entered her apartment, tied her up and kept her hostage. The women, Ashley Smith read from the bible and attempted to convince Nichols t turn himself in to police.She pled with him to be reasonable and he ultimately allowed her to leave the apartment he following morning, at which time she called 9-1-1 Nichols eventually surrenders when law e nforcement arrives. Nichols was indicted but pled not guilty. Nichols mental health issues will be used in the defense. The police chief has admitted a number of errors in the initial search for Nichols that occurred in the search for Nichols initially. It is unclear how Nichols could have escaped custody, found his may to the courtroom and then outside to the parking garage where he stole a car and drive thirty miles until he met with Ashley Smith.Civil suits by the victim’s families are likely. . It is likely that Bran Nichols had a substantial drug use history and or a serious mental heath issue. The lack of appropriate security measure and protocols allowed Nichols to escape from holding cell and murder three people.
